Your use of this site constitutes your agreement to all such terms, conditions and notices governing the use of this site found at http://www.pg.com/terms.htm and to the following additional terms:

1. Any use of the site and its features is solely for your personal and non-commercial use.

2. Materials and information posted to the Power A Smile Web site are not that of Duracell. You agree that any reliance on them will be at your own risk.

3. You agree that the photographs on the Power A Smile Web site will be considered as non-confidential and non-proprietary communications, and therefore others may view, copy, modify or redistribute your photograph without your knowledge. Use caution when posting photographs.

4. Duracell may, but is not obligated to monitor the information or photographs posted to the Power A Smile Web site but Duracell reserves the right not to post or to remove any information or photographs, or to terminate your access to the site at its sole discretion.

5. You agree that you will post only photographs of people who have each given their expressed permission to have their photographs posted on PowerASmile.com. Anyone under the age of 18 must consent expressly to you, through their parent or guardian, to have their photographs posted. You further agree that you will not post photographs for which you do not have the legal rights to do so. By posting any photograph, you represent that you own all the rights, title and interest in such photograph and that you have the express permission from all persons appearing in that photograph to submit such photograph. You further represent that the posting of such photograph will not infringe the rights, including the intellectual property, publicity rights or other rights, of any third parties including, but not limited to, the persons depicted in the photograph.

6. You agree that you will not:

• Defame, abuse, harass, stalk, threaten, embarrass, or otherwise violate the legal rights of others.
• Publish, post, upload, distribute or disseminate or offer to do the same ("Post") any inappropriate, defamatory, vulgar, racially or sexually charged, infringing, obscene, or unlawful material, photograph or information.

7. Your use of the Power A Smile Web site features is at your own risk.

8. Duracell shall be entitled to unrestricted use of your submissions/postings for any purpose whatsoever, without compensation to you.
